The platform serves as an online community facilitating:
A. For Hosts/Landlords (Accommodation Providers): - The creation and publication of property listings by uploading relevant details and media ("Content"). - Browsing through listings to connect with individuals seeking rental properties.
B. For Renters (Accommodation Seekers): - The creation of personal listings by uploading details about themselves as potential tenants. - Searching for available accommodations and connecting with hosts/landlords. These services, collectively referred to as the "Services," are subject to the following terms and conditions ("Terms"). By accessing or using the Website or its Services, you agree to comply with and be bound by these Terms. Roomforrent Ltd reserves the right to modify these Terms at any time, and changes will become effective upon publication on the Website. While we will endeavor to notify you of significant updates, users are responsible for periodically reviewing the most current version of these Terms. Key Definitions - Content: Refers to any media or information, such as photos, text, videos, and location data, related to rental properties or prospective tenants. - Listing: An advertisement offering rental properties or seeking accommodations. - Intellectual Property Rights: Includes copyrights, trademarks, patents, and other legal protections for intellectual property. - Personal Information: As defined under applicable privacy laws.
1. User Responsibilities for Listings
1.1 Uploading Listings Users uploading Content or creating Listings must: - Ensure the information provided is accurate, truthful, legal, lawful and not duplicated. No vulgarity or inappropriate pictures or text is allowed. - Regularly update the Listings and promptly remove them when no longer relevant (e.g., when accommodations are occupied or no longer available). Listing will be removed automatically after 28 days unless reactivated to keep the site current. - Independently assess any individuals they contact via the Website for suitability as tenants or co-tenants. Roomforrent Ltd does not conduct background checks or provide recommendations. -Identity verification helps to keep fake listings to a minimum however it is not a background check. -Reference checks may be available at a cost for Hosts/Landlords or the tenant to do through a third party provider.
1.2 Prohibited Content Roomforrent Ltd reserves the right to edit, deactivate, or remove Content or Listings that violate these Terms, are deemed inappropriate.
2. User Accounts
2.1 Registration To access certain features, users must sign up for an account ("Account") by providing accurate information, including name, email address, and a verified phone number. Users must: - Be at least 18 years old.. - Keep account credentials confidential and notify us immediately of any unauthorized access.
2.2 Account Termination Roomforrent Ltd may suspend or terminate your Account if: - You breach these Terms. - Your activities pose reputational risks to the company or violate applicable laws.
2.3.Payments, refunds and contracts -Payments made for boosting listings/unlocking e-signature contracts are non-refundable. Please, choose the appropriate duration for listings to be boosted. -Payment of the first month’s rent through the platform should only be made after viewing the property in person or at least on a video call. The payment is non refundable if you decide not to go ahead with the property/room. -Payment for the required deposit will need to be made prior to moving in. -The e-signature contract will be done through the website if the landlord has upgraded to this option.
2.4 Rent -Rent payments for month two and onwards will either be paid directly to the landlord or paid to Roomforrent Ltd client account if the Landlord has chosen the rent collection or managed service. Roomforrent Ltd will aim to forward the rent less any fees to the Landlord/Host within 72 hours.
2.5 Deposit -The deposit will be lodged with mydeposits.co.uk or similar UK approved deposit scheme in line with legal requirements.
3. Use of the Website and Services Users must not: - Use the Website for unlawful or unauthorized purposes. - Disrupt the Website's functionality or introduce harmful software. - Impersonate others or use false information. The Website may occasionally be unavailable due to maintenance or technical issues. Roomforrent Ltd is not liable for such interruptions.
4. Content Ownership and Usage Users retain ownership of their uploaded Content but grant Roomforrent Ltd a worldwide, royalty-free license to use, display, and distribute the Content as part of the Services. Users are responsible for ensuring their Content does not infringe third-party rights or contain inappropriate material.
5. Relationship Disclaimer Roomforrent Ltd: - Does not act as an agent for users or participate in rental agreements unless a lettings or managed service has been chosen by the landlord. - Is not involved in disputes or financial transactions between users. - Does not guarantee the suitability or quality of Listings, accommodations, or users.
6. Intellectual Property All intellectual property rights in the Website (excluding user-uploaded Content) belong to Roomforrent Ltd. Unauthorized use or reproduction of Website material is prohibited.
7. Liability The Website and Services are provided "as is." Roomforrent Ltd disclaims all warranties and is not liable for direct or indirect damages arising from the use of the Website or reliance on its Content.
8. Indemnity Users agree to indemnify Roomforrent Ltd against claims or losses arising from breaches of these Terms or misuse of the Website.
9. Governing Law These Terms are governed by the laws of England and Wales, Scotland and Northern Ireland and disputes will be resolved in the courts of the appropriate jurisdiction.
